Staying legal in NYC

NYC legal rentals

With over 50,000 listings NYC is Airbnb’s largest US market, 3rd worldwide after Paris and London. Staying legal is a primary concern for all Stayy users. Keep local laws in mind if you are charging your guests. As always make sure your guests are actually friends and family and double check with your lease agreement or HOA contract to avoid any legal issues.

It’s illegal for New Yorkers who live in buildings with three or more residential units to rent their apartments out for less than 30 days, unless the owner or leaseholder is present during the stay.

NYC Office of Special Enforcement website with information for hosts: https://www1.nyc.gov/site/specialenforcement/stay-in-the-know/information-for-hosts.page Listing various regulations like “Internal doors cannot have key locks that allow guests to leave and lock their room behind them. All occupants need to maintain a common household, which means, among other things, that every member of the family and all guests have access to all parts of the dwelling unit.” “New York State law also prohibits the advertising of an apartment in a Class A multiple dwelling, generally a building with three or more permanent residential units, for rent for any period less than 30 days.”

With so much enforcement going in to stopping people from making a few dollars, it’s shocking that little is done about the thousands of luxury condos sitting vacant in NYC as value storage for excessively wealthy owners.

Seems like we’ll eventually find some equilibrium between the people abusing the system creating airbnb hotels out of low rent buildings and the average person wanting to cover their rent cost while they are off on the one vacation they can afford every three years.

So let your friends and family use your tiny studio while you’re off on your next business trip. Maybe the’ll leave you a nice bottle of wine for your kindness, or repay the favor by making their ski cabin available to you. Sharing is caring and all that.
